Section 60-2F-15.1 - Persons permitted to conduct pull-tab games; premisesA. Only a veterans' or fraternal organization or a 501(c)(3) organization that is a bingo licensee may operate pull-tab dispensers when the organization is not concurrently operating a bingo occasion.B. The bingo licensee shall designate a bingo manager to be in charge and primarily responsible for the conduct of all games of pull-tabs. The bingo manager shall supervise all activities for which the bingo manager is in charge. The bingo manager shall be familiar with the provisions of the state laws, the rules of the board and the provisions of the bingo license. The bingo manager need not be present on the premises continuously while a veterans' or fraternal organization or a 501(c)(3) organization that is a bingo licensee is operating pull-tab games.C. The bingo manager shall designate a game accountant to be primarily responsible for the proper preparation of the quarterly reports in accordance with the New Mexico Bingo and Raffle Act.D. The premises where any game of chance is being held, operated or conducted, or where it is intended that any equipment be used, shall at all times be open to inspection by the board and its agents and employees and by peace officers of the state or any political subdivision of the state.E. No owner or co-owner of the premises or, if a corporation is the owner of the premises, any officer, director or stockholder owning more than ten percent of the outstanding stock, shall be designated as a bingo manager or a game accountant.F. Nothing in this section shall authorize a veterans' or fraternal organization or a 501(c)(3) organization to engage in class III gaming.G. As used in this section, "501(c)(3) organization" means an organization that demonstrates to the taxation and revenue department that it has been granted exemption from the federal income tax as an organization described in Section 501(c)(3) of the Internal Revenue Code of 1986, as amended or renumbered.Added by 2019, c. 161,s. 2, eff. 4/2/2019.
