Section 39:8-52 - Licensing of inspectors, feesa. A person shall not conduct any inspection required by the chief administrator on a motor vehicle or diesel bus, heavy-duty diesel truck, or any diesel-powered vehicle unless that person is licensed as an inspector by the chief administrator. The chief administrator may establish a fee not to exceed $50 for the licensure and relicensure of inspectors and shall establish standards and requirements for the licensure and relicensure of inspectors including, at a minimum, the successful completion of emission training and testing requirements determined by the chief administrator in consultation with the Department of Environmental Protection as a prerequisite to licensing. Any license issued pursuant to this section shall be valid for the period set by the chief administrator, which shall not be longer than two years. The successful completion of refresher training and testing, at a minimum, shall be required prior to license renewal. All fees collected pursuant to this subsection shall be turned over to the State Treasurer and deposited in the "Motor Vehicle Inspection Fund" established pursuant to subsection j. of R.S. 39:8-2.b. The chief administrator may deny, suspend or revoke any license authorized to be issued by this section or refuse renewal thereof for cause, including, but not limited to, one or more of the following: (1) Violation of any provision of P.L. 1995, c.112 (C.39:8-41 et al.) or of any regulation adopted pursuant thereto;(2) Fraud, misrepresentation or misstatement in securing the license or in the conduct of the licensed activity;(3) Conviction of a crime involving fraud or moral turpitude;(4) Violation of P.L. 1960, c.39 (C.56:8-1 et seq.) or of any regulation adopted pursuant thereto;(5) Failure to successfully complete any training or testing requirements that are a prerequisite to licensure;(6) Failure to pay any fee required by law;(8) Violation of P.L. 1995, c.157 (C.39:8-59 et seq.), or of any regulation adopted pursuant thereto.Amended by L. 2009, c. 331,s. 8, eff. 5/18/2010.
