Section 564-F:18-1803 - Damages in Absence of Breach of Duty(a) Even absent a breach of duty, a foundation official is accountable to an affected beneficiary for any profit made by the foundation official arising from the foundation's administration.(b) Absent a breach of duty, a foundation official is not liable to a beneficiary for a loss or depreciation in the value of the foundation property or for not having made a profit.(c) This section does not preclude the payment of reasonable compensation to a foundation official.Added by 2017, 257:47, eff. 10/1/2017. 2017, 257:47, eff.
