Section 21-O:17 - Definitions In this subdivision:
I. "Commissioner" means the commissioner of environmental services.II. "Coordinator" means the state pollution prevention coordinator.III. "Department" means the department of environmental services.IV. "Pollution prevention" means the use of materials, processes, or practices which reduce or eliminate the creation of pollutants or wastes at the source, or minimize their release into the environment prior to recycling, treatment, or disposal. When being practiced, it includes avoiding or minimizing the transfer of pollutant or waste generation and later disposal from one medium, such as air, water, or land, to another. It also includes: (a) Practices that reduce the use of hazardous materials, energy, or water or other resources;(b) Practices that protect natural resources and human health through conservation, more efficient use, or effective release minimization; and(c) Preferring actions that result in a greater net pollution prevention benefit, recognizing that improving one aspect of a process or activity may have other environmental effects, both positive and negative.V. "Small business" means a business which employs 20 or fewer employees and is independently owned and operated, or "small business" as defined in the Clean Air Act Amendments of 1990, 42 U.S.C. 7401 et seq., for purposes of complying with that act.July 1, 2020 repeal deleted by 2018, 89:2, eff. 7/24/2018.1996, 8:3, eff.
