Section 107.410 - "Borrower" defined"Borrower" means a natural person who is a mortgagor or grantor of a deed of trust under a residential mortgage loan. The term does not include a natural person who:
1. Has surrendered the secured property as evidenced by a letter confirming the surrender or the delivery of the keys to the property to the mortgagee, trustee, beneficiary of the deed of trust or an authorized agent of such a person.2. Has filed a case under 11 U.S.C. Chapter 7, 11, 12 or 13 and the bankruptcy court has not entered an order closing or dismissing the bankruptcy case, or granting relief from a stay of foreclosure or trustee's sale.Added to NRS by 2013, 2185Added by 2013, Ch. 403,§3, eff. 10/1/2013, applicable only with respect to trust agreements for which a notice of default is recorded on or after 10/1/2013, and to a judicial foreclosure action commenced on or after 10/1/2013.
