Section 678B.633 - Petition for exemption from prohibition on persons convicted of excluded felony offense being cannabis establishment agent or owner, officer or board member of adult-use cannabis establishment or medical cannabis establishment; grant or denial of exemption; conditions and limitations of exemption; regulations1. The Board shall develop and implement a process by which a person who has been convicted of an excluded felony offense may submit to the Board a petition for an exemption from the provisions of: (a) Paragraph (b) of subsection 3 of NRS 678B.210.(b) Paragraph (b) of subsection 3 of NRS 678B.250.(c) Paragraph (a) of subsection 6 of NRS 678B.340.2. The Board shall, in accordance with procedures established by the Board by regulation, review and evaluate each petition submitted pursuant to subsection 1 and grant or deny the exemption. The Board shall provide written notice to the petitioner of its decision to grant or deny the exemption.3. The Board may grant an exemption pursuant to this section only if the Board determines that granting the exemption would not: (a) Pose a threat to the public health or safety; or(b) Negatively impact the cannabis industry in this State.4. The Board may impose any conditions and limitations on the granting of an exemption pursuant to this section as the Board determines necessary to preserve the public health and safety or mitigate the impact of the granting of the exemption on the cannabis industry in this State. Such conditions and limitations may include, without limitation, conditions and limitations on the conduct of the petitioner in the cannabis industry in this State and the cannabis-related activities in which the petitioner is authorized to engage.5.
