Section 442.735 - Duties of grant recipient; confidentiality of information concerning recipient of services1. A local governmental entity or nonprofit organization that receives a grant pursuant to NRS 442.725 shall: (a) Inform a person to whom the entity or organization provides education concerning family planning which is funded by a grant of any methods or procedures that may be used to assist the person to achieve his or her goals concerning family planning. The information must include:(1) A clear explanation of family planning services, procedures, prescriptions and devices available directly from the entity or organization and those for which referral is required;(2) A description of any risks of the method or procedure, including possible negative outcomes and discomfort or pain that may result from using the method or procedure;(3) A description of the likely outcome and benefits of using the method or procedure;(4) A description of any alternative methods or procedures designed to accomplish the same goal; and(5) Answers to any questions the person has concerning the method or procedure.(b) Notify a person to whom the entity or organization provides education concerning family planning which is funded by a grant that the person is free to refuse any method or procedure about which the entity or organization informs the person pursuant to paragraph (a).2. Any personally identifiable information concerning a person to whom services funded by a grant pursuant to NRS 442.725 are provided is confidential. A local governmental entity or nonprofit organization that receives such a grant shall comply with all laws concerning the privacy of information, including, without limitation, the Health Insurance Portability and Accountability Act of 1996, Public Law 104-191, as amended, and applicable regulations.Added to NRS by 2017, 741Added by 2017, Ch. 164,§7, eff. 5/26/2017, op. 1/1/2018.
