Section 41.540 - Action may be brought against person causing pollution, impairment or destruction of air, water or other natural resources1. Any person who is a resident of this state may commence an action in any district court of this state where any violation is alleged to have occurred, to enforce compliance with any statute, regulation or ordinance for the protection of the air, water and other natural resources from pollution, impairment or destruction, if such person has first given 30 days' written notice of the person's intention to file suit.2. Such action shall be brought against the person, firm, company, corporation, association, county, city or town causing such pollution, impairment or destruction.
