Section 228.390 - Representation of public interest and customers' interests1. Except as otherwise provided in NRS 704.110 and 704.7561 to 704.7595, inclusive: (a) The Consumer's Advocate has sole discretion to represent or refrain from representing the public interest and any class of customers in any proceeding.(b) In exercising such discretion, the Consumer's Advocate shall consider the importance and extent of the public interest or the customers' interests involved and whether those interests would be adequately represented without his or her participation.(c) If the Consumer's Advocate determines that there would be a conflict between the public interest and any particular class of customers or any inconsistent interests among the classes of customers involved in a particular matter, the Consumer's Advocate may choose to represent one of the interests, to represent no interest, or to represent one interest through his or her office and another or others through outside counsel engaged on a case basis.(d) If the Consumer's Advocate declines to represent the public interest in a proceeding to review a proposed rate of an electric utility, the Consumer's Advocate shall publish a report in support of the decision to decline such representation and make the report available to the public at the Bureau of Consumer Protection and on the Internet website maintained by the Bureau of Consumer Protection. The report must: (1) Identify each element of the public interest, as may be applicable to the proceeding to review a proposed rate; and(2) Specify the manner in which each element of the public interest, as identified pursuant to subparagraph (1), is sufficiently represented.2.
