Section 70-17-216 - Home-based child careFor residential property subject to a covenant, providing child care in a family day-care home as defined in 52-2-703 or a group day-care home as defined in 52-2-703 is a residential use of property and is a residential purpose.
Added by Laws 2023, Ch. 169,Sec. 1, eff. 4/19/2023, applicable retroactively, within the meaning of 1-2-109, to covenants on residential property in existence before 10/1/2023 that do not clearly and expressly address child care, and applicable to covenants on residential property adopted on or after 4/19/2023 that do not clearly and expressly address child care.
