Section 7-13-3011 - Resolution creating district - power to order improvements(1) Before ordering any of the proposed improvements, the governing body shall pass a resolution creating the district in accordance with the resolution of intention introduced and passed by the governing body.(2) The governing body has jurisdiction to order improvements immediately upon the occurrence of one of the following: (a) when no protests have been delivered to the county clerk within 30 days after the date of the first publication of the notice of the passing of the resolution of intention;(b) when a protest is found by the governing body to be insufficient; or(c) when a protest is overruled.En.
