Section 10-3-402 - Local emergency - declaration and termination(1) A local emergency proclamation or disaster declaration may be issued only by the principal executive officer of a political subdivision.(2) An emergency proclamation may be issued by order or resolution whenever the principal executive officer determines there is an emergency.(3) An emergency proclamation may terminate with a disaster declaration or when the principal executive officer determines that the emergency no longer exists.En. 77-2307.2 by Sec. 9, Ch. 335, L. 1977; R.C.M. 1947, 77-2307.2(1), (2); amd.
