Section 320.088 - Personal protective equipment, standards for purchasing1. No fire protection district, volunteer fire protection association or any fire department of any political subdivision shall purchase any new personal protection equipment for structural firefighters unless such equipment meets the standards established in this section. The state fire marshal shall not purchase any equipment covered under this section unless such standards are met.2. The mandatory minimum standards for all new purchases of personal protective equipment for structural firefighters shall meet those standards adopted by the National Fire Protection Association (NFPA). Where no standards exist, the Occupational Safety and Health Administration (OSHA) fire brigades standards, 29 CFR 1910.156, shall apply until an NFPA standard is adopted.3. Nothing contained in this section shall be construed to require any fire protection district, volunteer fire protection association or any fire department of any political subdivision to purchase new equipment of any kind or type.
