If a health insurance issuer makes an adverse determination, the health insurance issuer shall include the following in the notification to the enrollee, the enrollee's health care professional, and the enrollee's health care provider:
(a) The reasons for the adverse determination and related evidence-based criteria, including a description of any missing or insufficient documentation;(b) The right to appeal the adverse determination;(c) Instructions on how to file the appeal; and(d) Additional documentation necessary to support the appeal.Added by Laws, 2024, ch. 302, SB 2140,§ 9, eff. 7/1/2024.
