Section 75-47-21 - MisbrandingNo person shall distribute misbranded fertilizer. A commercial fertilizer shall be deemed to be misbranded:
(a) If its labeling is false or misleading in any particular.(b) If it is distributed under the name of another fertilizer product.(c) If it is not labeled as required in Section 75-47-9 and in accordance with regulations prescribed under this chapter.(d) If it purports to be or is represented as a commercial fertilizer, or is represented as containing a plant nutrient or commercial fertilizer unless such plant nutrient or commercial fertilizer conforms to the definition of identity, if any, prescribed by regulation of the commissioner and state chemist. In the adopting of such regulations, the commissioner and state chemist shall give due regard to commonly accepted definitions and official fertilizer terms such as those issued by the Association of American Fertilizer Control Officials.Codes, 1942, § 4450-11; Laws, 1970, ch. 263, § 11, eff. 7/1/1970.
