A personal representative may withhold distribution until the court acts on the petition.(3) An inference of negligence on the personal representative's part shall not be drawn from failure to exercise the authority conferred by subsections (1) and (2).(4) If it becomes necessary or convenient in the settlement or distribution of a decedent's estate to appoint a trustee to take charge of or invest and distribute a portion of the estate, the court may appoint a trustee upon the request of the personal representative or another interested person.Amended by 2009, Act 46,s 33 , eff. 4/1/2010.1998, Act 386, Eff. 4/1/2000.
