Section 38.1006 - "Member" defined(1) Except as otherwise provided in subsection (2), "member" means any of the following: (a) A legislator of this state.(b) The secretary of the senate who served not less than 6 months before January 1, 1979, and for not less than 3 months after January 1, 1979.(c) The clerk of the house who served not less than 6 months before January 1, 1979, and for not less than 3 months after January 1, 1979.(d) The lieutenant governor.(2) Member does not include any of the following:(a) An individual who elects not to participate in the retirement system under section 18.(b) An individual who first becomes a legislator or lieutenant governor on or after March 31, 1997.(c) An individual who elects to terminate membership under section 61 and who, but for that election, would otherwise be eligible for membership in Tier 1 under section 18.1957, Act 261, Eff. 9/27/1957 ;--Am. 1979, Act 52, Imd.
