Section 14:67.7 - [Effective 8/1/2024] Theft or unauthorized reproduction of a mail receptacle key or lockA. As used in this Section, the following terms shall have the following meanings:(1) "Mail" means any letter, postal card, parcel, envelope, package, bag, or any other sealed article addressed to another, along with its contents.(2) "Postal service" means the United States Postal Service or its contractors, or any commercial courier that delivers mail.B. Any of the following acts shall constitute theft or unauthorized reproduction of a mail receptacle key or lock: (1) Stealing or obtaining by false pretense any key or lock adopted by a postal service for any box or other authorized receptacle for the deposit or delivery of mail.(2) Knowingly and unlawfully making, forging, or counterfeiting any such key, or possessing any such key or lock adopted by a postal service that delivers mail with the intent to unlawfully or improperly use, sell, or otherwise dispose of the key or lock, or to cause the key or lock to be unlawfully or improperly used, sold, or otherwise disposed.C.(1)Whoever violates the provisions of this Section shall be imprisoned, with or without hard labor, for not more than five years, or fined not more than five thousand dollars, or both. (2) Upon a second or subsequent conviction or violation of the provisions of this Section, the offender shall be imprisoned, with or without hard labor, for not less than one year nor more than ten years and may, in addition, be fined not more than twenty thousand dollars.D. In addition to the penalties provided in Subsection C of this Section, a person convicted under this Section shall be ordered to make full restitution to the victim and any other person who has suffered a financial loss as a result of the offense in accordance with Code of Criminal Procedure Article 883.2.Added by Acts 2024, No. 67,s. 1, eff. 8/1/2024.
