§ 240. Collecting an outstanding balance; prohibition

(a) The Puerto Rico Electric Power Authority shall not collect outstanding electric power bills for electric power services provided to a property previously occupied by a defaulting customer from a new customer requesting electric power services for the same property. Any unpaid balance shall constitute a personal obligation of the prior customer, and the Puerto Rico Electric Power Authority shall resort to the appropriate legal means to collect any outstanding electric power bill.

(b) The Puerto Rico Electric Power Authority shall not refuse to provide electric power services to a new customer requesting such services for a property that was previously occupied by a defaulting customer until the arrearage is paid in full.

(c) This provision shall not apply to juridical persons or entities created by a person related to the defaulting customer within the third degree of consanguinity or second degree of affinity or created by the defaulting customer. This section does not preclude the Puerto Rico Electric Power Authority from collecting or denying services to a new customer who is a member of the family unit of the defaulting customer or has otherwise benefited from the services previously provided in the property.

(d) The Puerto Rico Electric Power Authority is hereby empowered to adopt regulations as are necessary and convenient to achieve the purposes of this section.
