§ 2517. Public auction sale

The Administrator shall provide in the rules and regulations approved under § 2502 of this title a proceeding for the seizure and sale in public auction of every abandoned ship or merchandise or which illegally obstructs any port, dock or part of a harbor zone, or of every merchandise on which there is pending a fine or payment under the provisions of this chapter, if the ship or merchandise is not moved or the debt on the merchandise has not been paid within a reasonable term which must be stipulated in the corresponding requirement made by the Authority by serving a written notice thereof to the owner or captain of the ship, or to the agent of any of the two (2), or to the owner or consignee of the merchandise, or by fixing said notice on the ship or on the merchandise in question, if none of said persons could be found or are unknown. From the proceeds of the sale, the Authority shall charge any sums owed by the ship or merchandise under the provisions of this chapter, plus the expenses incurred in removing the obstruction and in the public auction sale procedure. The remaining surplus, if any, shall be given to the person entitled to receive it.
