§ 2414. Pilot fees

Every ship subject to pilot service as provided in §§ 2412 and 2413 of this title, and every ship which requests and obtains said service without being subject to same, shall pay the following fees to the pilot rendering the service (or to the pilot in his stead who offers to render said services in the event that the ship’s captain refuses the service, the ship being subject to such services):

(a) Four dollars ($4) for each foot or fraction of foot in excess of six (6) inches drawn by the ship in the deepest drawing on any of its two (2) sides in its route through the port in normal waters.

(b) Twenty-five additional dollars ($25) if the ship has to be towed because it is unable to move under its own power.

(c) Half fee as indicated in subsections (a) and (b) for every movement, change or shifting of berth of the ship after it has cast anchor or has come alongside a port, except when the shifting of berth requires moving the ship from one side to another side of the same dock or from one dock to another not contiguous.

(d) Twice the fee indicated in subsections (a), (b) and (c) if the service is rendered after sunset and before sunrise.

(e) Half fee as indicated in subsections (a), (b) and (d), except as to subsection (c) if the ship enters port in need of aid, or with the only purpose of taking water, fuel or provisions in order to continue voyage.

(f) Twice the corresponding fee if the ship’s captain refuses the service, the ship being subject to receive it.

The Puerto Rico Ports Authority shall revise and fix discretionally the pilot fees established in subsections (a), (b), (c), (d), (e) and (f), taking into consideration the tradition, use, custom and the variables that may affect such fees.

The Authority shall prepare a regulation to establish the rights and duties of the parties which are directly or indirectly related to maritime transportation and the pilot service to ships. This regulation shall be made within a term of not more than twelve (12) months on and from the date in which this legislative measure becomes a law.
