§ 2203. Administrative fines and action for collection

The Administrator may include in the rules or regulations, approved in accordance with this chapter, provisions for imposing and payment of reasonable administrative fines, which shall not be less than twenty-five (25) or more than five hundred dollars ($500), for violations to the rules or regulations; and may, within these same limitations, provide by rules or regulations for imposing and payment of such fines for violations to this chapter or to the Regulation of Docks and Harbors of Puerto Rico of 1928. If the fine has not been paid within thirty (30) days of the written notice of its imposition, the Authority may begin a civil action before the Court of First Instance for the collection of the fine and for a sum equal to its amount for indemnity which the court may, in its discretion, include in the judgment in the measure deemed fair, plus the proceeding costs and a reasonable sum for attorney’s fees. The defendant may raise before the court all defenses it may have against the imposition of the fine. The payment of the fine within the said term of thirty (30) days shall constitute an impediment to any criminal action under the provisions of this chapter for the same violation which caused the imposition of the fine.
