§ 1135. Definitions

For the purposes of §§ 1131—1135 of this title, the following terms and phrases shall have the meaning listed below:

(a) Gasoline. — Shall mean, include and encompass gasoline, benzine, naphtha and any other fluid prepared, advertised, offered for sale, sold to be used for, or used for the generation of power or energy needed for the propulsion of motor vehicles, including any product obtained by mixing one (1) or more products derived from petroleum, or from natural gas or of any other origin, if the resulting product can be given the same use.

(b) Special fuels. — Shall mean and include diesel oil, kerosene, and oils or fluids used in diesel engines or internal combustion motors for the propulsion of motor vehicles, including any product obtained by mixing or combining one (1) or more petroleum products or any other products, if the resulting product can be given the same use.

(c) Petroleum producer. — Shall mean any natural or juridical person that directly or indirectly conducts, or directs within and without the Commonwealth of Puerto Rico, any activities related to the extraction of petroleum or natural gas from the earth, or that produces gasoline or special fuels by any method.

(d) Petroleum refiner. — Shall mean any natural or juridical person who refines petroleum, petroleum products, natural gas or its derived products, within and without the Commonwealth of Puerto Rico.

(e) Distributor-wholesaler. — Shall mean any natural or juridical person that conducts activities for the sale and/or distribution of gasoline and/or special fuels, or any corporation, entity or enterprise that conducts activities for the retail sale of gasoline and/or special fuels, and in which any producer, refiner or wholesaler-distributor, as previously defined in this subsection, is a stockholder or has any other kind of financial interest.

(f) Retail sales service station. — Shall mean and include a place of business operated by a natural or juridical person where gasoline, special fuels and motor vehicle fuels are sold and are delivered by depositing them in the tanks of the motor vehicles.

(g) Retailer. — Any natural or juridical person who operates a retail sales service station.
