§ 187c-4. Old Cemeteries of Ponce—Administration

(a) Transfer of functions to Municipality of Ponce.— All of the functions, powers, duties and faculties of the Corporation for the Conservation and Administration of the Old Cemeteries of Ponce are hereby transferred to the Municipality of Ponce, as well as the personnel, real and personal property, records, and any unspent sums from appropriations, items, or other Commonwealth or federal funds, or of any other kind, held and in custody of said Corporation. The funds needed to provide continuity to these functions shall be defrayed by the Municipality of Ponce from its Expense Budget.

(b) Guarantee to employees.— All employees affected by the transfer provided in this section, are hereby guaranteed all the vested rights, privileges, obligations and conditions under the personnel laws and regulations in effect at the time of approval of this section, as well as any existing pension, retirement, or savings and loan system or systems to which they may be affiliated or subscribed upon approval of this section.

(c) Agreements, covenants, claims, or contracts.— None of the provisions of this section shall be construed to modify, alter, or invalidate any agreement, covenant, claim, or contract in effect as of the date of approval of this section, nor during the transfer period. Once transferred, the Mayor of the Municipality of Ponce may renegotiate, terminate, or modify the same.

(d) Applicability of other acts.— All those acts, rules, regulations and orders applicable to the Corporation for the Conservation and Administration of the Old Cemeteries of Ponce that are not in conflict with the acts, rules, regulations and orders applicable to the Municipality of Ponce, shall remain in effect until the same are amended, repealed, or substituted.

(e) Temporary provisions.— The Mayor of the Municipality of Ponce may adopt such temporary measures and make the necessary decisions in order to make the transfer decreed by this section, without interrupting the administrative processes and functions of the matters and programs thus transferred.

(f) Administration.— Once the services, obligations and duties of the Corporation for the Conservation and Administration of the Old Cemeteries of Ponce have been transferred to the jurisdiction of the Municipality of Ponce, the Mayor shall establish the administrative structure that is most appropriate, convenient, and necessary for the continuity of the rendering of services.
