(a) In those cases in which one of the following causes occurs at the moment that the certified plans and documents are submitted for approval, the agency must check and review them before proceeding to approve the works:
(1) When the certifying professional had previously been guilty of faults or violations of the applicable laws and/or regulations for the certification of projects.
(2) When the certifying professional is the object of an administrative or legal proceeding for alleged violations of §§ 73—73 l of this title, or of the act which regulates the practice of his profession.
(b) In those cases in which the agency delays approval due to one of the causes expressed in this section, said agency shall notify him of the grounds for the delay, in writing, on or before ten (10) days.
