For the purposes of being able to petition and obtain the permit referred to in § 64 of this title, the following requirements must be complied with:
(a) That the urbanizations, streets or communities have a residents council, board or association, duly organized and registered with the Department of State as a non-profit institution.
(b) That in the urbanization, street or community there is no building or facility owned by the Commonwealth of Puerto Rico or the municipalities for the use and enjoyment of the general public, except those destined for schools, recreational parks or community centers.
(c) That the request for authorization to control the access or accesses to the urbanization, street or community be adopted by at least three fourths (¾) of the proprietors of the dwellings established therein. Participation of said proprietors shall be limited to one owner per dwelling and shall be stated, in writing, under the signature of each. An authorization to apply for the permit to control a point or points of access to the urbanization, street or community given voluntarily by an owner of legal age and in representation of a dwelling, shall bind the owner to comply with the provisions of § 64d-3 of this title, and shall be in full force and effect as long as no written document which clearly revokes the authorization granted on a prior date, is issued. A revocation of authority to petition for a permit to control the access or accesses to the urbanization, street or community shall be valid only if it is presented at any time until the first public hearing is held. The provisions in § 64d-3 of this title shall apply after that date. Those persons who favor the implementation of the system shall do so expressly and, in writing, at the time that steps are being taken to obtain the necessary authorizations from the owners to request the access control permits.
(d) That the community commits itself and guarantees to assume the installation, operation and maintenance expenses of the facilities needed to control access to the urbanization or community.
