§ 42i. Certification of plans—Prescription of penal action

For the purposes of the prescription on penal liability established in §§ 42g and 42h of this title, it is hereby provided that said prescription shall commence as of the date in which the act which constituted a violation occurred. If as a result of the conduct prohibited by §§ 42g and 42h of this title, the death of a human being occurs, penal liability shall commence as of the date in which the death occurred. In no case may an action be initiated five (5) years after the date on which the act which gave place to the violation occurred or which caused the death.
