(a) Individual health plan issuers offering individual health plans shall provide written certification of creditable coverage to all individuals in accordance with subsection (b).
(b) The certification of creditable coverage shall be provided:
(1) At the time an individual ceases to be covered under the health plan or otherwise becomes covered under a Consolidated Omnibus Budget Act of 1986 (COBRA) continuation provision;
(2) in the case of an individual who becomes covered under a Consolidated Omnibus Budget Act of 1986 (COBRA) continuation provision, at the time the individual ceases to be covered under that provision, and
(3) at the time a request is made on behalf of an individual if the request is made not later than twenty-four (24) months after the date of cessation of coverage described in clause (1) or (2), whichever is later.
(c) Individual health plan issuers may provide the certificate of creditable coverage required in subsection (b)(1) consistent with the applicable Consolidated Omnibus Budget Act of 1986 (COBRA) continuation provisions.
(d) The Commissioner shall establish through policy letters all the requirements that any certification of creditable coverage required under subsection (a) shall contain, subject to the applicable federal regulations regarding the content of such document, the requirements for issue, and the use thereof.
