(a) A health insurance organization or issuer shall be responsible for the oversight of all activities carried out under this chapter and for ensuring that all the requirements thereof and applicable regulations are met.
(b) If a health insurance organization or issuer contracts with another person to carry out activities required under this chapter or applicable regulations, the Commissioner shall hold the health insurance organization or issuer responsible for the oversight of the activities of the contracted person and for ensuring that the requirements of this chapter and applicable regulations with respect to such activity are met.
