§ 9004. Insurance Code of Puerto Rico

The provisions of the Insurance Code of Puerto Rico shall apply to health insurance plans and entities regulated by this Code inasmuch as they are not inconsistent with the provisions thereof.

Nothing provided in this Code shall be construed to amend or repeal the laws, regulations, or procedures administered by the Patients” Advocate Office and the Puerto Rico Health Insurance Administration (ASES) in accordance with their enabling acts.

Any issuer that enters into contracts with ASES to offer, market, or administer the Puerto Rico Government Plan (Mi Salud) shall meet the requirements and comply with the legal, regulatory, and contractual provisions established by ASES, except for matters related to the authorization or license required to engage in the insurance business in Puerto Rico, and those pertaining to financial solvency to which the Puerto Rico Insurance Code and this Code shall apply.
