§ 1095. Definitions

The following terms shall have the meaning stated below unless another meaning clearly arises from the context:

(a) Agency.— Shall mean any department, bureau, commission, board, dependency, instrumentality, public corporation, authority, or any subsidiary thereof or entity affiliated thereto, or any other branch of the Central Government.

(b) Urban center.— Shall mean that geographic portion that comprises the center or core of a town or city which has been defined as such by the municipality in an area plan, or designated as historic zone, or delimited by the Board of Directors with the advice of the Planning Board and in close coordination with the mayor of the municipality subject to renewal.

(c) Internal Revenue Code of 1994.— Shall mean §§ 8006 et seq. of Title 13, known as the “Puerto Rico Internal Revenue Code of 1994.”

(d) Historic zone.— Shall mean the geographic portion delimited as a historic zone by the Institute of Puerto Rican Culture and the Planning Board.

(e) Exaction by impact.— Shall mean any fee or exaction imposed by the agencies on a project that affects the public service infrastructure within or outside the urban center limits.

(f) Autonomous Municipalities Act.— Shall mean §§ 4001 et seq. of this title, known as the “Autonomous Municipalities Act of the Commonwealth of Puerto Rico of 1991”.

(g) Improvement.— Shall mean any investment equal to or higher than twenty-five percent (25%) of the market value of the property subject to revitalization, prior to commencing the work, including the value of the land where it is located.

(h) Person.— Shall mean a natural or juridical person.

(i) Area plan.— Shall mean the area plan adopted for the urban center under a Territorial Ordinance Plan.

(j) Rehabilitation plan.— Shall mean the plan approved by the Territorial Ordinance Plan Office of those municipalities with area plans, or historic zones or the Board of Directors, with the advice of the Planning Board, and by the mayor of the municipality for the rehabilitation of the urban center.

(k) Urban center rehabilitation projects.— Shall mean any project or work addressed to repopulating, renewing or revitalizing urban centers through the development of housing, businesses, professional offices, industries, the forestating [sic] of sidewalks and squares, parking lots, community areas, parks, recreational areas and structures, repair and construction of structures, development of empty or under-used lots and infrastructure needed to develop and make any of the [latter] feasible.

(l) Department.— Shall mean the Department of Transportation and Public Works.

(m) Director.— Shall mean the Executive Director of the Office of the Urbanism Director created by this chapter.

(n) Office of the Director.— Shall mean the Office of the Urbanism Board of Directors created by this chapter.

(o) Secretary.— Shall mean the Secretary of the Department of Transportation and Public Works.
