§ 3114. Adequate inter-hospital transfer

An inter-hospital transfer is deemed to be adequate:

(a) When the medical institution that receives the patient has available space and qualified personnel to provide treatment, accepts the transfer, and agrees to provide adequate medical treatment;

(b) when the hospital transferring the patient provides the receiving medical institution with medical records, or copies thereof, regarding the examinations or treatment administered to the patient in said hospital, and

(c) when the transfer is carried out by qualified personnel using adequate transportation equipment, including the use of appropriate life support means during the transfer.
