§ 948. Barbiturates and other dangerous drugs—Administrative fines

Any person who shall violate any provision of §§ 930—949 of this title or its regulations and which violation is a purely technical one, as may be prescribed by the Secretary of Health through regulation to that effect, may avail himself of an administrative fine which shall not exceed five hundred dollars ($500) for each violation. The amount of this fine shall be determined according to the magnitude and seriousness of the violation and no fines in excess of one hundred dollars ($100) shall be imposed except in those cases in which the commission of the act prohibited or prescribed might seriously endanger the efficacy of the administration of §§ 930—949 of this title. Payment of the fine so imposed by the Secretary of Health shall preclude any other sanction for the violations committed.
