Every person who violates the provisions of §§ 671—673 and 676—678 of this title and/or the regulations promulgated by the Secretary of Health for the best enforcement hereof shall be guilty of a misdemeanor and, upon conviction, shall be punished by a fine of not less than twenty-five dollars ($25) or by imprisonment in jail for a term of not less than twenty-five (25) days, or by both penalties, in the discretion of the court; Provided, That in case of subsequent offenses the permits and/or special licenses granted under the provisions of §§ 671—673 and 676—678 of this title shall be cancelled and there shall also be imposed upon him a fine of not less than one hundred dollars ($100) or imprisonment in jail for a term of not less than ninety (90) days, or both penalties, in the discretion of the court; Provided, further, That for the purposes of §§ 671—673 and 676—678 of this title, person shall be understood to be every natural or artificial person or the managing partner, manager, agent, or representative of said natural or artificial person, or the directing partner or manager of a civil or mercantile partnership committing the violation.
