The Secretary of Health may, in the exercise of the duties and powers imposed and conferred upon him by §§ 91—91i of this title, issue subpoenas, and should any person so subpoenaed fail to appear, or, if upon appearing before the Secretary of Health, refuses to take oath, or to give testimony, answer any pertinent question, or present any pertinent document when so ordered, the Secretary of Health may call on the Court of First Instance to compel such appearance, testimony, or presentment of document. Said Court shall, upon just cause shown, order any person to appear before the Secretary of Health and present any documents or give testimony concerning the matter at issue. Failure to obey the court’s order shall be punishable as contempt. Any person failing or refusing to appear and testify, or disregarding any licit requirement, or refusing to present books, papers and documents when it is in his power to do so, in compliance with a subpoena or valid requirement of the Secretary of Health, shall be guilty of a misdemeanor and shall, upon conviction thereof, be punished by a fine of not less than fifty dollars ($50) nor more than five hundred dollars ($500), or by imprisonment in jail for a period of not less than thirty (30) days nor more than one (1) year, or both penalties, in the discretion of the court.
