§ 1029a. Scholarship Fund for Children of Members of the Police Corps

(a) The Scholarship Fund for Children of Members of the Police Corps, hereinafter denominated as the “Fund”, is hereby created as a special fund, not subject to a particular fiscal year, distinct and separate from all other monies or funds of the Government of the Commonwealth of Puerto Rico.

This Fund shall be administered in accordance with the norms and regulations adopted by the Police of Puerto Rico, in harmony with the provisions in effect for the administration of similar funds.

The Fund shall be used exclusively by the Puerto Rico Police to grant scholarships to the children of members of the Police who die in the performance of their official duties or because of health conditions or accidents related to the performance of the official duties or when, being off-duty, they die as a result of their intervention to prevent the commission of a crime. The Fund shall be funded from:

(1) The appropriations provided by this section and those appropriated in the future to the Fund created herein by the Legislature.

(2) Any other monies that are donated, transferred or ceded by any private person or entity, or federal, Commonwealth or municipal government entity; which must be used in accordance with the conditions of the donation or legal ones applicable to each case.

These items shall be covered into the Fund and the unexpended remainder is not required to revert to the General Fund at the end of the year, pursuant to the provisions of §§ 283 et seq. of Title 3.

(b) The Police Superintendent shall administer the Fund and through regulations to that effect shall establish everything concerning the form, manner and conditions by which said Fund shall be used and channeled.

(c) In addition to those requirements fixed by the Police Superintendent through regulations, the following shall be minimum requirements that must be met by the students in order to qualify for the benefits of the Fund:

(1) Pass the entrance examination to an institution of higher education recognized by the Council on Higher Education or by the Department of Education, as the case might be.

(2) Maintain an academic average not lower than “C” or its equivalent.

(3) Attend a study program that accredits them as regular students.

(4) Not go beyond the time programmed by the institution to obtain the degree in question.

(5) Observe good conduct and maintain an interest in their courses.

(6) Every grantee shall have the duty to send an official record to the Police Superintendent of the grades obtained in his studies every semester, as well as a certificate from the academic institution attesting that he is a regular student.

(d) The following causes will justify the cancellation of economic assistance within the regulations that will be established by the Superintendent of the Police of Puerto Rico:

(1) When the general academic average of the student at the educational institution is less than “C” or its equivalent.

(2) When the student was submitted to corrective measures because of misconduct.

(3) Irregular class attendance or non-compliance with the norms, regulations and other requirements of the teaching institution.

(e) The Police Superintendent shall select the number of students allowed by the annual resources of the Fund for those purposes, from among those that qualify; Provided, That the amount of each scholarship shall not exceed one thousand dollars ($1,000), except in the case of scholarships intended for studies whose annual cost exceeds one thousand dollars ($1,000), in which case, it can be increased up to two thousand dollars ($2,000), annually.
