§ 544. Seizure, arrest and confiscation

When the weapons, instruments or devices referred to in this chapter are not surrendered to the Police of Puerto Rico within the term of sixty (60) days prescribed in § 543(a) of this title, or when, after said term has expired, any police agent or peace officer of Puerto Rico shall catch any person in the act of bearing, carrying, transporting or possessing any such weapon, instrument or device, it shall be the duty of said agent or officer to seize the said weapon, instrument or device and to arrest such person so caught in the act of bearing, carrying, transporting or possessing same in violation of this chapter and hold him to answer for the offense incurred.

It shall be the duty of the Court of First Instance of Puerto Rico, which is hereby vested with jurisdiction to take cognizance of violations of this chapter, to order the confiscation of such weapons, instruments or devices so possessed by the said police agents or peace officers as soon as the judgments rendered by said court against the violators of this chapter become final and conclusive. Such weapons, instruments or devices shall be confiscated by the police.
