§ 2234. Faculties and duties

The faculties and duties of the Board shall be:

(a) To evaluate all applications received for licenses and renewal of licenses to practice the profession of interior designer-decorator.

(b) To offer examinations at least twice a year.

(c) To authorize the practice of the profession of interior designer-decorator in the Commonwealth of Puerto Rico, by issuing licenses and in accordance with the provisions of this subchapter.

(d) To adopt the rules and regulations that are needed for the faithful compliance [with] this subchapter, its duties and functions, provided the same are not contrary to the public law and order, and are adopted after holding public hearings and are promulgated in accordance with the provisions of the Uniform Administrative Procedures Act of the Commonwealth of Puerto Rico, §§ 2101 et seq. of this title.

(e) To keep an Official Registry of each and every one of the interior designers/decorators who are duly licensed by law, with their names and addresses, and remit a copy of this roster to the College. The Board shall subsequently remit to the College every six (6) months a supplemental list of all persons to whom a license has subsequently been issued, so that the College may proceed in conformity with the provisions of §§ 2244 et seq. of this title.

(f) To adopt the necessary rules and regulations with regard to the continuing education requirement; Provided, That any continuing education course required shall be offered by the College and by other institutions independent from the College, in order to ensure that College members have several options to meet the continuing education requirements established by this subchapter. Said regulations shall specify the content, duration and organization of the continuing education courses. These courses shall have a duration of at least fifteen (15) hours per year.

Upon establishing the rules and regulations, the following criteria shall be taken into consideration, among others:

(1) The guidelines and statements of the College and other interior designer/decorator institutions or professional associations recognized for their merits.

(2) The accessibility that interior designers have to the means of the required continuing education.

(3) The type of evidence required to meet this requirement, pursuant to the continuing education regulations established by the Board.

The Board, pursuant to the regulations adopted to such an effect, shall delegate the functions related to the administration of the Continuing Education Program [to] the College.
