§ 2182. Board—Creation, composition

(a) There is hereby created the Board of Examiners of Nutritionists and Dietitians of Puerto Rico, attached to the Office of Regulation and Certification of Health Professionals of the Department of Health, which shall have under its charge everything relative to the granting, suspension and revocation of licenses to practice the nutritionist and dietitian professions in the Commonwealth.

(b) The Board shall be composed of five nutritionists or dietitians appointed by the Governor with the advice and consent of the Senate, which shall enjoy good repute, be of legal age, citizens of the United States, and have resided in the Commonwealth of Puerto Rico for at least three (3) years immediately prior to their appointment. The latter shall hold a bachelor’s degree with a major in nutrition or dietetics from a college or university accredited by the Council of Higher Education, and shall not have less than five years of experience in the exercise of their respective professions at the date of their appointments. If the candidate holds a master’s or doctor’s degree in nutrition or dietetics, or in other fields related to these subjects, there shall only be required one year of experience in the field of his/her specialty. Once appointed, no member of the Board may be a shareholder or belong to the Board of Trustees or Directors of a university, college or school where studies leading to a degree as nutritionist or dietitian are included.

The Governor may consider competent candidates submitted to him to act as members of the Board by bona fide entities which have a legitimate interest in the work of the Board.

(c) Board members shall be appointed to four (4) -year terms and shall hold office until their successors are appointed and take office. Any vacancy which may occur before the expiration of the term of a member has expired, shall be filled for the remainder of the unexpired term. No person shall be appointed for more than two (2) consecutive terms.

(d) The members of the Board shall serve ad honorem but shall receive a fifty-dollar ($50) per diem for each day or fraction thereof that they devote to their official duties and shall be entitled to be reimbursed for travel expenses in which they may incur while carrying out their functions in accordance with the applicable regulations of the Department of the Treasury.

(e) The Governor may remove from office any member of the Board, upon previous notice and hearing, for unbecoming conduct, for neglect in the fulfillment of his obligations or for gross incompetence in the discharge of his office.

(f) The funds collected through the enforcement of this chapter shall be covered into the General Fund of the Commonwealth Treasury.
