(1)
(a) The annual fees of the College shall be established in the Bylaws Assembly by the affirmative vote of two-thirds of the members present; Provided, That quorum for the Assembly shall not be less than twenty-five percent (25%) of the licensed professionals, certified and recertified to practice occupational therapy in Puerto Rico. The fees may vary from time to time, provided that a General Assembly is called for such purposes in which the above is approved by the vote of two-thirds of the members present. The minimum quorum in an assembly to change the fee shall be the one established in the bylaws, but shall not be less than twenty-five percent (25%) of the total number of active members who attend for such purposes.
(b) Any member who ceases the active practice of occupational therapy in Puerto Rico to pursue activities that are not relevant to the profession, to leave Puerto Rico or to definitely retire from the practice thereof shall be entitled to continue to be a member of the College or to submit a sworn application to the Board of Directors to cancel his/her membership. Any member of the College who chooses to cancel his/her membership shall not be bound to pay the fee for the period of voluntary inactivity, but shall also not be entitled to the benefits that the College offers its members and neither shall he/she practice the profession in Puerto Rico. The member shall also notify the Board by means of a copy of the application to cancel membership so that for his/her license shall become inactive, excepting when the license is required by the corresponding authorities for the practice of occupational therapy profession in another jurisdiction, which shall be duly justified. The occupational therapy professional shall not return to the active practice of the profession in Puerto Rico until he/she reactivates his/her membership and license. Applications to cancel membership that are not notified to the Board shall have no effect.
(2) Occupational therapy professionals shall have the right to object the use of the fees by the College to hold activities in which ideological, sectarian, labor union, religious, sexist, racist or classist issues are involved. For such purposes, the College shall establish a simple and easily implemented procedure in its bylaws for whoever wishes to object, in accordance with the applicable constitutional parameters.
