§ 322. Board—Creation and terms

The Board of Examiners of Histologic Technicians and Histotechnologists is hereby created, attached to the Department of Health. Said Board shall be constituted by five (5) members who shall be appointed by the Governor of Puerto Rico with the advice and consent of the Senate. One (1) of the members shall be a physician, specialized in pathology and duly authorized to practice medicine in Puerto Rico. Two (2) members shall be histologic technicians with educational experience in the field of histology with more than five (5) years experience in the practice and having been active in the practice for a term of not less than three (3) years immediately before being appointed. The two (2) remaining members shall be Histologic Technicians with more than five (5) years experience and having been active in the practice for a term of not less than three (3) years immediately before being appointed. Professional histology and medical organizations and associations may recommend candidates to the Governor for membership in the Board.

The members of the Board shall each hold office for a term of four (4) years and until their successors are appointed and take office.

No member of the Board may be appointed for more than two (2) consecutive terms.

The initial appointments of the members of the Board shall be made for the following terms: three (3) for a term of four (4) years and two (2) for a term of five (5) years. The vacancies that arise in the Board shall be filled in the same manner in which the original appointments are made. The term of the member filling a vacancy shall be extended for the term remaining to its predecessor.
