§ 1336h. Penalties

All natural or juridical persons who violate the provisions of this chapter or the regulations promulgated thereunder shall incur a felony and, if convicted, shall be punished by imprisonment for a fixed term of three (3) years. In the event of aggravating circumstances, the fixed penalty shall be increased to a maximum of up to five (5) years. In the event of extenuating circumstances, the penalty may be reduced to a minimum of two (2) years. The court, in its discretion, may impose a fixed imprisonment penalty established or a fine of up to fifty thousand dollars ($50,000) for each day of violation, or both punishments.
