§ 1320l. Penalties

(a) Violations.— Any violation of the provisions of this chapter or of the terms and conditions of the municipal plans approved by the Authority, shall be punishable with a fine of not less than one hundred dollars ($100) nor greater than five hundred dollars ($500) for each violation, or imprisonment that shall not exceed six (6)months, or both penalties, at the discretion of the court.

(b) Municipalities.— Failure to comply with the requirement of preparing a Recycling Plan that may be approved or of any other provision of this chapter could result in the imposition of a fine of up to one thousand dollars ($1,000) per day for each violation, on the municipality or municipalities that form part of the municipal consortia that incur non-compliance. Said penalties shall be covered into the Recycling Trust Fund established by this chapter. Likewise, the failure of an agency to comply with the implementation of any of the parts required by this chapter could result in the imposition of a fine of up to one thousand dollars ($1,000) per day for each violation.
