When it shall become necessary to clean and clear the channels of rivers or creeks of rubbish or sand, stone, or other objects deposited by the water, which obstruct or turn the current and threaten to cause damage, the riparian estates shall consent to the temporary servitude and the deposit of the material removed, payment being made for any loss or damage or the proper bond being furnished.
