If the servitude is a temporary one, the owner of the land shall be paid, prior to its establishment, a sum representing double the rental corresponding to the duration of the charge for the part occupied, as well as the amount of the damages and injuries caused the remainder of the estate, including those caused by reason of its division by the ditch. Furthermore, it shall be the obligation of the owner of the dominant tenement, upon the conclusion of the servitude, to restore things to their original condition. If the servitude is permanent, payment shall be made for the value of the land and the loss and damage which may be caused the remainder of the estate.
