§ 732. Form of aqueduct servitude

A compulsory aqueduct servitude shall be established in the following manner:

(1) By means of an open ditch, when not dangerous by reason of its depth or location, nor inadvisable for other reasons.

(2) By means of a covered ditch, when necessary on account of its depth, its proximity to dwellings or roads, or any other similar reason, or in the judgment of the proper authority.

(3) By means of tubes or piping when other waters already appropriated might be absorbed, when the waters conducted might infect other waters or absorb noxious substances, or cause damage to works or buildings, and provided the necessity therefor should be established in the respective proceedings.
