§ 730. Servitude within preexisting aqueduct

Nor can a compulsory aqueduct servitude be established within a preexisting aqueduct; but if the owner of the latter should consent and the owner of the servient tenement object, proper proceedings shall be instituted to compel the owner of the tenement to agree to the new charge, upon compensation, if a larger strip of land belonging to him were to be occupied.
