§ 701. Lower tenements obliged to receive natural flow; damages

Lower tenements are obliged to receive the water flowing naturally and non-artificially thereon from higher tenements as well as the stones or earth which such water carries with it in its course. But if the water has been brought to the surface by artificial works or is the overflow from irrigating ditches, or issues from industrial establishments, which have not acquired such rights of way, the owner of the lower tenement shall be entitled to damages.

The owners of lower estates or establishments may object to receiving the overflow from industrial establishments which contains or carries with it dissolved noxious substances which have been introduced therein by the owners of such establishments.
