§ 25j-1. Prohibited practices

It is hereby prohibited to toss, discharge or order the tossing or discharging or depositing of oil, acid, poison or any other substance that kills or destroys the fish, crustaceans or mollusks in any lake, lagoon, spring, river, stream, channel or any current of water of Puerto Rico. Provided, That when any natural or juridical person has the need to toss into the sea or any lake, lagoon, spring, river, stream, channel or any current of water of Puerto Rico, the residue or waste from a factory, or industrial or agricultural enterprise, it shall be mandatory for it to previously obtain the corresponding permit [from] the Federal Environmental Protection Agency and the Environmental Quality Board. Any natural or juridical person that violates the provisions of this section shall incur a misdemeanor, and upon conviction thereof, shall be sanctioned with the penalty of a fine of not less than five hundred dollars ($500) nor more than three thousand dollars ($3,000). The provisions of this section shall not be construed in the sense of preventing the pertinent sanitary authorities from discharging substances necessary to protect the public health, into the water.
