§ 25e. Special fishing permits

(a) Any natural or juridical person who is engaged whether on a full-time or part-time basis, in the catching or fishing of live aquatic or semiaquatic species for scientific research, educational purposes, exhibition, aquaculture, marketing and possession of aquarium fishes, must file an application with the Secretary for one of the following permits:

(1) Catching permit.

(2) Import and export permit.

(3) Possession permit.

These permits shall have an effective term of one year.

(b) In addition to their fishing license, commercial fishermen must hold the following permits, which shall be included in the commercial fishing license voucher, to fish the following species:

(1) Common lobster fishing.

(2) King Conch fishing.

These permits shall have an effective term of one (1) year, except for those fishermen who are sixty (60) years of age or over, who shall have the benefit of holding such permits for life.

(c) In addition to their fishing license, recreational fishermen must have the following permits to fish the following species:

(1) Special recreational fishing permits.

(2) Lobster fishing.

(3) King Conch fishing.

(4) Billfish and Swordfish fishing.

(d) Any person who wishes to engage in fishing for recreational purposes in locations designated by the Department for such purposes and under the custody and supervision of the officer in charge of such facilities, may obtain—in default of the recreational fishing license and provided the requirements established through regulations are met—an incidental fishing permit, to be issued by the corresponding officer in charge or any other authorized person upon whom the Secretary has expressly delegated. This permit shall be effective for the day on which it was issued, for a fee which shall be determined through regulations. The Department may require permits by regulations, for catching other aquatic or semiaquatic species. These permits shall have an effective term and cost to be established by regulations.

Persons who contract the services of a holder of a rental boat owner recreational fishing license shall be exempted from holding a recreational fishing license; however, any fish caught must be included in the statistical report.
